For entrepreneurs: We retain ownership until all claims from the current business relationship have been fully paid. You may resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from resale up to the invoice amount, and we accept this assignment. You remain authorized to collect these claims; however, we may collect them ourselves if you do not meet your payment obligations. Upon request, we will release securities if their realizable value exceeds the secured claims by more than 10%.

8. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please notify the carrier immediately and contact us without delay. Failure to notify or contact us does not affect your statutory rights, particularly warranty rights, but helps us assert our own claims against the carrier or insurer.

For entrepreneurs: The risk of accidental loss or deterioration passes to you as soon as we have delivered the goods to the carrier, freight forwarder, or other person or institution charged with shipping.

9. Warranty and Guarantees

9.1 Warranty Rights

Unless expressly agreed otherwise below, statutory warranty rights apply.

The following limitations do not apply to claims for damages caused by us or our legal representatives or agents:

  • Injury to life, body, or health

  • Intentional or grossly negligent breach of duty or fraud

  • Breach of essential contractual obligations (cardinal duties)

  • Within the scope of an agreed guarantee

  • If product liability law applies

Limitations for Entrepreneurs
For entrepreneurs, only our product descriptions and those of the manufacturer included in the contract constitute an agreement on the condition of the goods; public statements or advertising by the manufacturer are excluded from liability. The limitation period for warranty claims for newly manufactured goods is one year from the transfer of risk. This does not apply if the goods are used for a building and caused its defectiveness.

Statutory limitation periods for recourse claims remain unaffected.

Note for Merchants
Merchants are subject to the inspection and complaint obligations under § 377 German Commercial Code (HGB). Failure to notify renders the goods approved unless the defect was not discoverable during inspection or we concealed the defect fraudulently.

9.2 Guarantees and Customer Service

Information on any additional guarantees and their terms can be found with the product and on special information pages in the online shop.

10. Liability

We are fully liable without limitation

  • For injury to life, body, or health

  • For intentional or grossly negligent breaches

  • For agreed guarantees

  • Where product liability law applies

For slight negligence in breaching essential contractual obligations (cardinal duties), our liability is limited to foreseeable damages typical for the contract.

Other claims for damages are excluded.

11. Final Provisions

If you are an entrepreneur, German law applies excluding the UN Sales Convention (CISG).

Should individual provisions of these Terms be wholly or partly invalid, the contract remains effective otherwise. Invalid clauses shall be replaced by statutory provisions.
